The 2001 General Assembly enacted the Voluntary Environmental Remediation Act (VERA) to encourage volunteers to clean up contaminated properties or brownfields through increased liability protection for participants. Within this act, KRS 224.01-510 to 224.01-532, the Voluntary Environmental Remediation Program (VERP) was established. VERP is a formalized voluntary cleanup program by which an applicant can enter into an agreed order with the Environmental and Public Protection Cabinet to obtain a covenant not to sue upon completion of an approved corrective action plan. VERP establishes clear procedures and provides timeframes for cabinet review of documents. The program includes a strong public notification and public comment requirement. There are less formal processes that may fulfill your cleanup needs.
